What is the plusvalia tax in Spain?

“Because a lot of people still struggling with the question , I will explain exactly what the capital gain tax is” ! ( PLUSVALIA )

The plusvalía is a local (municipal) tax charged by the town hall on properties when they are sold. It is calculated on the rateable value of property and the number of years that have passed since the property last changed hands. The objective is to tax the increase in the value of the land on which the property stands, some of which is due to improvements to the area carried out by the local government and the community at large.The base for this tax is the valor catastral (an administrative value that is usually lower than the market value, sometimes considerably so) of the property. The amount due in tax will depend on how long the seller has owned the property: the longer the period, the higher the amount of tax.

If you are a vendor, and you are resident in Spain, you are better off paying this tax yourself, as if the buyer fails to pay it, the tax authorities will come after the vendor.

If you are a buyer, and the vendor does not live in Spain, you are better off paying this tax on behalf of the vendor using funds withheld from the property price. That way you can be sure the tax has been paid. Because if the vendor doesn’t pay, and doesn’t live in Spain, the tax authorities will come after the new owner.

How do you pay the plusvalia tax ?

You have 30 days from the date of sale to pay the plusvalia to the town hall.

If you (the vendor), are not resident in Spain (whatever your nationality), the buyer may insist on withholding funds to pay the plusvalía on your behalf, as the new owner would become liable for the plusvalía in the event of non-payment (i.e. if a non- resident does a runner without paying).

The weather woman was right in the meantime it is “HOT” in Spain, Since 1975, only 10 heat waves have been counted so early in the year. 8 of them came after 2001, a sign that the climate is changing. The summers in Spain are getting warmer, with 2017 as the record holder so far …….

A 17-year-old boy dies after having a stroke while working in the bright sun on the land. Yesterday an 80-year-old man died after fainting in the heat. It is therefore highly recommended not to make great efforts during the hottest hours of the day!

The Spanish Ministry of Health advised the population to stay indoors, especially during the hottest hours of the day. Salads , water and juices are recommended for survival at hellish temperatures.

Facts about Alfaz and Albir

Alfaz del Pi was originally built to stop the pirates who wanted to enter the village from Albir . The name Alfàs comes from the Moorish Alfaz which means fertile land. And that is reflected in the orange trees in the area 🙂 This village has one of the highest concentration of European immigrants in all Spain, including mainly Norwegians, English and Dutch.

Albir and Alfaz belong to the same municipality!

Alfaz del Pi werd van oorsprong gebouwd om de piraten tegen te houden die via Albir het land wilden binnenkomen. De naam Alfàs komt van het Moorse Alfaz wat vruchtbaar land betekent. En dat zie je terug in o.a. de overvloedig behangen sinaasappelbomen in de omgeving 🙂 Dit dorp kent een van de hoogste concentratie Europese immigranten van heel Spanje, waaronder voornamelijk Noren, Engelsen en Nederlanders. Albir en Alfaz behoren tot de zelfde gemeente  !

De echte liefhebbers van een goed glas wijn mogen de Bodega van de beroemde wijnmaker Enrique Mendoza zeker niet missen !!!

Enrique Mendoza is een wijnmaker met een in de familie gegroeide, grote passie voor het maken van de beste wijnen. Hij geniet dan ook van een grote, internationale vermaardheid in het maken van elegante en zeer smaakvolle kwaliteitswijnen en deelt de geheimen daarvan graag met zijn bezoekers.

Hypotheek in Spanje Nieuwe wet sinds Juni 2019

Hieronder noemen we de belangrijkste punten welke directe gevolgen hebben voor het aangaan van een hypotheek in Spanje:

  1. Clausula suelo: de zogenaamde tunnelclausule of ook wel vloerclausule genoemd. Bij alle hypotheken die met een variabele rente getekend zullen worden, zal er geen limiet ofwel minimale rente vastgelegd mogen worden.
    Echter zullen de banken geen negatieve rente betalen in het geval de Euribor negatief is.
     
  2. De termijn voor het opeisen van de hypotheek bij wanbetaling zal in het belang van de cliënt versoepeld worden. Op deze manier wordt er meer kans gegeven aan de cliënt om zich te herstellen bijvoorbeeld na een persoonlijke financiële crisis.
     
  3. De belangrijkste en direct in de portemonnee voelbare verandering heeft betrekking op de vestigingskosten van een hypotheek. De kosten die gemaakt worden bij het tekenen van de hypotheekakte zullen grotendeels ten laste komen van de Spaanse banken. Dit zijn in concreet de notariskosten, registerkosten, hypotheekbelasting, administratiekosten en eventuele overnamekosten en omzetkosten (van vaste rente naar variabele rente).

De volgende maximale limieten voor provisies voor vervroegde aflossing zijn vastgesteld

  • Vaste rente hypotheek: 2% in de eerste 10 jaar van de lening een 1,5 vanaf het 11 jaar!
  • Variabele rente hypotheek : 0,25% in de eerste 3 jaar van de lening en 0,15% vanaf het 4 jaar!
